Failing which, use of the application is prohibited.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<h3><strong>1.\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 Definition<\/strong><\/h3>\n<p>For the purposes of these GTCU, the following terms shall have the definitions below:<\/p>\n<ul>\n<li>&#8220;The Company&#8221;, &#8220;the Owner&#8221;, &#8220;the Publisher&#8221; or &#8220;we&#8221;: designates the publisher of the Application appearing in the Legal Notice of the Application.<\/li>\n<li>&#8220;Application&#8221;: designates the My Uriki\u00ae application described below.<\/li>\n<li>&#8220;User(s)&#8221; or &#8220;you&#8221;: means any natural person who uses or accesses the Application.<\/li>\n<\/ul>\n<h3><strong>2.\u00a0 \u00a0 \u00a0 \u00a0 \u00a0Purpose<\/strong><\/h3>\n<p>The purpose of these General Terms of Use is to define the rights and obligations relating to the use of the application. They shall enter into force on the date of their publication on the application and shall be enforceable against the User from the first use of the application.<\/p>\n<h3><strong>3.\u00a0 \u00a0 \u00a0 \u00a0 \u00a0Modification of the ToU<\/strong><\/h3>\n<p>We may make changes to the General Terms of Use from time to time at our sole discretion, by updating these ToU in the Application, and by specifying the effective date of the new version of the ToU. If the General Terms of Use are modified, the revised policy will be published in the Application. You must therefore periodically review the Application&#8217;s ToU. Your continued use of this Application after the publication of a new version of the ToU constitutes your acceptance of these changes.<\/p>\n<h3><strong>4.\u00a0 \u00a0 \u00a0 \u00a0 \u00a0Term<\/strong><\/h3>\n<p>The use of the application is for an indefinite term; we may terminate it at any time, which you, the User, accept without reservation. You may discontinue using the Application at any time.<\/p>\n<h3><strong>5.\u00a0 \u00a0 \u00a0 \u00a0 \u00a0Presentation of the Application<\/strong><\/h3>\n<h4><strong>5.1\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Description<\/strong><\/h4>\n<p>The My Uriki\u00ae Application is a mobile application published by the company IKI.<\/p>\n<p>The Application allows persons requiring nutritional monitoring to transmit urine analysis data performed at their home using a Uriki\u00ae connected urine analyser and to receive recommendations from their healthcare professionals.<\/p>\n<p>The Application provides access, in particular, to features allowing:<\/p>\n<ul>\n<li>To view, after validation by the healthcare professional, the results of the urine tests performed with the Uriki\u00ae reader and the Uriki\u00ae Test cartridges,<\/li>\n<li>To send photos of their meals to healthcare professionals,<\/li>\n<li>To enter their hydration level for healthcare professionals,<\/li>\n<li>To consult the advice and recommendations of healthcare professionals,<\/li>\n<li>To report a problem encountered at the time of an analysis performed with the Uriki\u00ae reader and\/or the Uriki\u00ae Test cartridges.<\/li>\n<\/ul>\n<p>The information concerning hydration data and meal photos is the responsibility of the User; the company IKI is in no way responsible for this information.<\/p>\n<h4><strong>5.2\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Download Modalities<\/strong><\/h4>\n<p>The Application is available on the Apple\u00ae and Google<sup>TM<\/sup> download platforms, App Store\u00ae and Play Store<sup>TM<\/sup>. It can be downloaded free of charge and can be installed on Android<sup>TM<\/sup> smartphones using version 8.0 or higher and iPhone\u00ae using iOS\u00ae version 14.4 or higher. The visuals of the Application may vary depending on your platform, without affecting its use.<\/p>\n<h3><strong>6.\u00a0 \u00a0 \u00a0 \u00a0 \u00a0Access to the Application<\/strong><\/h3>\n<h4><strong>6.1\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Availability of the Application<\/strong><\/h4>\n<p>The My Uriki\u00ae application is available on the Internet, accessible free of charge 24 hours a day, 7 days a week, to any User with Internet access. All costs related to accessing the application, of any kind (including hardware costs or Internet access) shall be borne exclusively by the User, who is solely responsible for the proper functioning of their computer equipment and their Internet access.<\/p>\n<p>The publisher shall use all reasonable means at its disposal to ensure access to the My Uriki\u00ae application, but is under no obligation to achieve this, which the User accepts without reservation. The publisher reserves the right, without prior notice, to temporarily or permanently suspend the use of all or part of the application, in particular to update it, modify it, perform maintenance on it, or for any other technical and organisational reason. Consequently, the publisher may not be held liable in any way whatsoever, and on any grounds whatsoever, in the event of, in particular, the temporary or total unavailability of all or part of the application, any difficulty related to response time, and, more generally, any performance failure of all or part of the application.<\/p>\n<h4><strong>6.2\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Initialising Your Account<\/strong><\/h4>\n<p>To access your My Uriki\u00ae personal space, an account must be created for you by the person designated by the medical team within your healthcare centre who has administrator rights.<\/p>\n<h4><strong>6.3\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Activating Your Account<\/strong><\/h4>\n<p>Once your account has been created, you will receive an email confirming your registration. This email, from the Uriki\u00ae Board platform, contains your user ID. It allows you to activate your account and log in to your personal space on the My Uriki\u00ae application.<\/p>\n<p>To activate your account, simply follow the steps below:<\/p>\n<ul>\n<li>Click on the link received by email.<\/li>\n<li>Choose a password. Once this action is complete, you can return to the My Uriki\u00ae application login page.<\/li>\n<li>Read and accept the General Conditions of Use (GCU).<\/li>\n<li>Enter your password and your user ID.<\/li>\n<li>You can then start using the My Uriki\u00ae application.<\/li>\n<\/ul>\n<h4><strong>6.4\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Forgotten Password<\/strong><\/h4>\n<p>If you have forgotten your password, you can click on \u201cForgotten password?\u201d on the login page. You will need to enter your user ID to receive an email that will allow you to reset your password.<\/p>\n<h3><strong>7.\u00a0 \u00a0 \u00a0 \u00a0 Application Terms of Use<\/strong><\/h3>\n<p>By using all or part of the My Uriki\u00ae application, you acknowledge that you have read, understood and accepted these General Terms of Use. Your use of this application or of any other content provided through this application shall be deemed to constitute your consent to be legally bound by the General Terms of Use of this Agreement, which shall be enforced in the same manner as if you had signed this Agreement.<\/p>\n<p>Furthermore, you agree not to perform the following actions: (1) use this Application in any manner that could disable, overburden, damage, or impair this Application, or interfere with any other use of this Application, including any user&#8217;s ability to engage in real-time activities through this Application; (2) use any robot, spider, or other automatic device, process, or means to access this Application for any purpose, including to retrieve, data-mine, monitor or copy all or part of the material on this Application; (3) use any manual process to monitor or copy all or part of the material on this Application, or for any other unauthorised purpose without the express prior written consent of the Application Owner; (4) otherwise use any device, software, or routine that may interfere with the proper working of this Application; (5) otherwise attempt to interfere with the proper working of this Application.<\/p>\n<p>We reserve all rights not expressly granted to you.<\/p>\n<h3><strong>8.\u00a0 \u00a0 \u00a0 \u00a0 \u00a0Medical advice<\/strong><\/h3>\n<p>The My Uriki\u00ae application, including the content of the application, in particular the text, graphics, images and information obtained from My Uriki\u00ae and its licensors, is not intended to be used to provide medical advice, nor as a substitute for a consultation with a healthcare provider. The Application is intended to assist healthcare professionals in better managing their patients&#8217; nutrition. It is exclusively intended for use with the Uriki\u00ae urine analysis reader and the Uriki\u00ae Test urine cartridges.<\/p>\n<p>The information provided by the My Uriki\u00ae application may under no circumstances constitute the basis for the diagnosis of any medical condition or for any treatment. Individuals are always recommended to consult a physician or other qualified healthcare provider regarding their medical condition before starting any new treatment. This Application is not intended as a substitute for professional advice provided by a qualified healthcare provider who is familiar with the User&#8217;s specific personal characteristics. Individuals are recommended never to disregard professional medical advice or delay in seeking it because of something read or learned from the My Uriki\u00ae application.<\/p>\n<h3><strong>9.\u00a0 \u00a0 \u00a0 \u00a0 \u00a0Intellectual Property<\/strong><\/h3>\n<p>The Publisher grants the User, worldwide, on a personal basis, the non-exclusive and non-transferable right to use the My Uriki\u00ae application \u2013 to the exclusion of any other use \u2013 subject to the User&#8217;s acceptance of these GTCU. The User is expressly prohibited, without the prior written consent of the Publisher, from copying, modifying, improving, editing, creating a derivative work, reverse engineering or decompiling or in any other way attempting to find the source code (except in cases provided for by law), assigning, sub-licensing or transferring in any way whatsoever all or part of the My Uriki\u00ae application. Any reproduction, representation, or exploitation of any kind whatsoever and for any purpose whatsoever, of all or part of the Application, and in particular of its structure and\/or content, without the prior written authorisation of the Publisher shall constitute acts of infringement. No element of the content may be reverse engineered, disassembled, decompiled, reproduced, transcribed, stored in a retrieval system, translated into another language or computer language, retransmitted in any form or by any means (electronic, mechanical, photocopying, recording or otherwise), resold or redistributed without our prior written authorisation.<\/p>\n<p>The Uriki\u00ae trademark is a protected trademark within the meaning of intellectual property law and is the exclusive property of the company IKI. Any reproduction of these trademarks without the prior authorisation of the company is prohibited.<\/p>\n<h3><strong>10.\u00a0 \u00a0 \u00a0 Limitations of liability<\/strong><\/h3>\n<p>The measurement results displayed on the Application result from the User&#8217;s use of the Uriki\u00ae connected reader and the Uriki\u00ae Test cartridges. The company IKI cannot guarantee that the information available on the My Uriki\u00ae application is free from errors, nor guarantee its completeness, exhaustiveness, or its perfect suitability for the User&#8217;s personal profile. The company cannot be held liable for the use made thereof by the User.<\/p>\n<p>The Owner of the Application assumes no liability and you shall in no way hold it liable for any delays, failures, interruptions, corruption, or inaccuracies of data or other information transmitted or made public in connection with the use of the My Uriki\u00ae Application, including any data or other information transmitted or made public by a healthcare provider. You expressly understand and agree that under no circumstances shall the owner of the application or any of its directors, officers, employees, agents, mandataries, or other representatives be liable for direct, indirect, special, incidental, consequential, punitive, or aggravated damages, including, without limitation, any loss of use, loss of income, savings or profits, loss of data, loss of goodwill, any cost of procurement of substitute services, or any other indirect, special, incidental, or consequential damages, howsoever caused, and on any theory of liability, whether in breach of contract, tort (including negligence and strict liability), or otherwise, arising from (1) the use of, or inability to use, the application; (2) the cost of procurement of substitute services, items, or applications; (3) unauthorised access to or alteration of your transmissions or data (including personal information); (4) the statements or conduct of any third party on the application; (5) the acts or omissions of any healthcare provider relating to the access to and verification of, or the failure to access or verify, your data or other information; or (6) any other matter relating to the Application. These limitations shall apply whether or not the owner of the Application has been advised of the possibility of such damages and notwithstanding any failure of essential purpose of any limited remedy. This exclusion of liability shall apply to the fullest extent permitted by applicable law.<\/p>\n<h3><strong>11.\u00a0 \u00a0 \u00a0 \u00a0 Protection of personal data and privacy policy<\/strong><\/h3>\n<h4><strong>11.1\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Data controller<\/strong><\/h4>\n<p>The processing of personal data carried out in the context of the use of the Application is performed under the responsibility of the healthcare personnel or the healthcare facility that prescribed or implemented the use of the Application. <\/p>\n<p>This data controller determines the purposes and means of the processing, in particular in the context of patient monitoring and the associated medical care. <\/p>\n<p>For any questions relating to the exercise of your rights or to the protection of your personal data, you may contact the facility or the healthcare professional who is monitoring you, in accordance with the information provided to you when your care began.\u00a0<\/p>\n<h4><strong>11.2\u00a0\u00a0\u00a0\u00a0\u00a0 Information we collect<\/strong><\/h4>\n<p>When you use the Application, we may collect and process data that are necessary for the operation of the Application and its features. This includes information that you transmit to us directly or data that we collect automatically.<\/p>\n<p>We remind you that you have given your authorisation to the healthcare professional under the terms of which you have accepted that the latter may collect and process your personal data and have thereby acknowledged that IKI cannot be held liable in this respect.\u00a0You may withdraw your consent at any time, free of charge.<\/p>\n<h4 style=\"padding-left: 40px;\">11.2.1\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Data you transmit to us directly<\/h4>\n<p>By using our Application, you will be required to transmit information to us, some of which is of a nature to identify you. This information is never made public. The information you transmit to us contains the following data:<\/p>\n<ul>\n<li>Contact details (such as name, email address).<\/li>\n<li>Account information (such as password, username, serial number of any device associated with the account).<\/li>\n<li>Demographic information (such as date of birth, gender).<\/li>\n<li>Payment or commercial information (such as billing details).<\/li>\n<li>Information on claims or adverse events.<\/li>\n<li>Your preferences (such as language and time zone).<\/li>\n<li>Health information (such as medical condition, urinary marker values, meal photos and hydration declarations).<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p>When you are asked to provide your personal data, you may choose not to provide them. However, this may hinder our ability to provide you with certain elements of the services.<\/p>\n<p>If you provide information about someone other than yourself (for example, if you are a healthcare professional, parent or guardian providing information about a patient), you confirm to us that you have all necessary authorisation, consent or other authority to share the other person&#8217;s information and to allow us to use it in accordance with this Privacy Policy.<\/p>\n<h4 style=\"padding-left: 40px;\">11.2.2\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Data we collect automatically<\/h4>\n<p>When you use our service and our features, we collect information regarding your activity on the Application:<\/p>\n<ul>\n<li>Data relating to your activity on the Application: when you access the features and use the Application and its features, information may be collected and processed concerning the way in which you use them. This includes, in particular, the registration date and the last login.<\/li>\n<li>Data relating to devices and equipment: we collect information from and about the devices and equipment you use to access our Application such as server logs, which may include, in particular, information such as IP addresses, application version, mobile phone model, mobile ID, language used, operating system, and application crashes.<\/li>\n<\/ul>\n<h4><strong>11.3\u00a0\u00a0\u00a0\u00a0\u00a0 How are the collected data used?<\/strong><\/h4>\n<p>The data collected by the company are necessary for the provision of the service and the proper functioning of the Application by virtue of the service contract that binds us (terms of use). Your data may thus be processed for the following purposes:<\/p>\n<ul>\n<li>Creation and management of your account as a User (including management of access to the service and customer support),<\/li>\n<li>Provision of the service and features,<\/li>\n<li>Producing statistics within the framework of its service, satisfaction surveys and marketing-type analyses in connection with the use of the Application and the services for the purposes of improving and optimising the service and features, with such statistics, surveys and analyses in no way allowing you to be identified.<\/li>\n<\/ul>\n<p>Where the processing is based on the User&#8217;s consent to the processing of their data, the User may withdraw it at any time by contacting the healthcare professional and\/or centre that collected it; the withdrawal of your consent does not affect the lawfulness of processing carried out prior to such withdrawal.<\/p>\n<h4><strong>11.4\u00a0\u00a0\u00a0\u00a0\u00a0 Who has access to the data?<\/strong><\/h4>\n<p>The data collected or processed are transmitted to healthcare professionals and to IKI&#8217;s contractual service providers and partners, including the certified health data host, who are involved in and contribute to the management of the services and for whom it is necessary to access the data entered by the User. These third-party service providers and partners may have the capacity of data controllers or processors within the meaning of French legislation and European regulations.\u00a0\u00a0Personal data are accessible only to authorised persons, within the strict limits of their respective duties.<\/p>\n<p>The data are hosted in France and no data are transferred outside the European Union.\u00a0The company may transmit certain data at the request of state bodies and to comply with any judicial or legal request.\u00a0Finally, we may be required to transmit your data in the context of corporate transactions such as, but not limited to, restructuring, change of control, merger, acquisition, transfer, or dissolution.<\/p>\n<h4><strong>11.5\u00a0\u00a0\u00a0\u00a0\u00a0 Statement of the user&#8217;s rights<\/strong><\/h4>\n<p>In accordance with Act No. 78-17 of 6 January 1978, known as the Data Protection Act (Loi Informatique et Libert\u00e9s), and the GDPR, each User has a right of access to and rectification of their personal data and, where applicable, a right to data portability and erasure, as well as a right to object to or restrict the processing and the right to define directives concerning the fate of their personal data after their death. The Application provides access, in particular, to functionalities allowing:<br \/>\u2022 To calculate, validate and view all the results of the urine analyses performed by the patient using a Uriki\u00ae connected urine analyser and Uriki\u00ae Test cartridges and transmitted via the My Uriki\u00ae smartphone application,<br \/>\u2022 To display the photos of meals sent by patients via the My Uriki\u00ae smartphone application,<br \/>\u2022 To monitor the hydration levels declared by the patients,<br \/>\u2022 To send patients advice and recommendations,<br \/>\u2022 To create, modify, and manage the accounts of the team&#8217;s healthcare professionals and of patients, <br \/>\u2022 To define individualised thresholds for each patient and for each urinary marker. The application&#8217;s interface has been optimised for the Mozilla, Edge, Chrome and Safari internet browsers.<\/p>\n<h3><strong>6.\u00a0 \u00a0 \u00a0 \u00a0\u00a0 Availability of the Application<\/strong><\/h3>\n<p>The Uriki\u00ae Board application is available on the Internet network, accessible 24 hours a day, 7 days a week, to any User with Internet access and a Uriki\u00ae Board account. All costs pertaining to access to the application, whatsoever (in particular hardware costs or Internet access), shall be borne exclusively by the User, who is solely responsible for the proper functioning of their computer equipment as well as their Internet access. The publisher shall use all reasonable means at its disposal to ensure access to the Uriki\u00ae Board application, but is under no obligation to succeed in doing so, which the User accepts without reservation. The publisher reserves the right, without prior notice, to temporarily or permanently suspend the use of all or part of the application, in particular to update it, modify it, perform maintenance thereon, or for any other technical and organisational reason. It is intended exclusively for use with the Uriki\u00ae urine analysis reader, the My Uriki\u00ae smartphone application and the Uriki\u00ae Test urine cartridges. The information provided by the Uriki\u00ae Board application may under no circumstances constitute the basis for the diagnosis of a medical condition or of any treatment. It is always recommended that individuals consult a physician or other qualified healthcare provider regarding their medical condition before starting any new treatment.\u00a0<\/p>\n<h3><strong>9.\u00a0 \u00a0 \u00a0 \u00a0 \u00a0Intellectual Property<\/strong><\/h3>\n<p>The Publisher grants the User, worldwide, on a personal basis, the non-exclusive and non-transferable right to use the Uriki\u00ae Board application \u2013 to the exclusion of any other use \u2013 subject to the User&#8217;s acceptance of these General Conditions of Use.
